Joint Bulletin on Industrial Hemp Testing

On September 21, 2018, the Colorado Department of Agriculture (CDA), The Department of Revenue’s Marijuana Enforcement Division (MED), and the Colorado Department of Public Health and Environment (CDPHE), issued a joint industry bulletin regarding the scope and extent of permitted testing on industrial hemp by retail marijuana testing facility licensees.

In a nutshell, the state governing agencies for hemp and licensed marijuana will allow Industrial Hemp and Industrial Hemp Product manufacturers to test through licensed Retail Marijuana Testing Laboratories as long as they meet specific criteria.

  • If you produce Industrial Hemp, you must have a CDA Hemp Registration and a METRC license. (METRC is the Department of Revenue’s Seed-to-Sale tracking system.)
  • If you manufacture Industrial Hemp Products, you must have a CDPHE Registration, a METRC license, and provide the CDA Registration number indicating the origin of the material to be tested.

Testing with Botanacor Services

Testing at a licensed Marijuana Testing Facility requires your business to be under the purview of the CDA, the CDPHE, and the Marijuana Enforcement Division. Additionally, your industrial hemp and industrial hemp products will be tracked using the State’s tracking software, which has an annual fee of $250.00 and requires you to purchase RFID tracking tags. If you purchase your hemp from a source that is not from Colorado and registered with the CDA, you cannot access these laboratories legally.
